Terms of Service

Gurbat (the "Platform") is owned and operated by RAMEXAR LLC, a limited liability company organized in the United States ("RAMEXAR LLC", "Gurbat", "we", "us", or "our"). By accessing or using the Platform, including the website (gurbat.com) and mobile applications, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Platform. We reserve the right to update these terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised terms.

Gurbat is a community platform designed for immigrants. The Platform provides social networking features, marketplace services (jobs, housing, shipping, business listings), educational resources (English learning, DMV test prep, citizenship test prep), and immigration-related informational content. The Platform is available in English, Azerbaijani, Turkish, and Russian.

You must be at least 18 years old to create an account. Gurbat is an 18+ platform and is not intended for minors. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration. You may not use another person's account without permission. You must notify us immediately of any unauthorized use of your account.

You retain ownership of content you post on the Platform. By posting content, you grant Gurbat a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the Platform. You are solely responsible for the content you post. Content must not violate any laws, infringe on intellectual property rights, contain harmful or misleading information, or include hate speech, threats, or harassment. We reserve the right to remove any content that violates these terms. Gurbat administrators may review messages, including private messages and their attachments, when needed to enforce our rules, investigate reports, keep users safe or comply with the law; access is limited to authorized administrators and is recorded.

ZERO TOLERANCE: Gurbat has zero tolerance for objectionable content and for abusive users. By creating an account, posting content, or otherwise using the Platform, you agree to these Terms of Service, which constitute the End User License Agreement (EULA) governing your use of Gurbat. The following is strictly prohibited: harassment, bullying, hate speech, threats of violence, sexually explicit or pornographic material, any content that sexualizes minors, spam, fraud or scams, impersonation, and any other illegal content. All public user content is reviewed before it is published, and Gurbat additionally applies an automated filter that blocks objectionable language. You can report any content or any user directly from inside the app, and you can block an abusive user at any time. You can also delete your own posts at any time. RAMEXAR LLC reviews every report and acts on objectionable content within 24 hours: the content is removed and the user who posted it is ejected from the Platform without notice, as described in Section 6. Repeat or severe violations result in a permanent ban. To report inappropriate activity, contact support@gurbat.com.

You agree not to: use the Platform for any illegal purpose; impersonate any person or entity; post spam, scams, or fraudulent content; attempt to gain unauthorized access to the Platform or other users' accounts; use automated systems (bots, scrapers) without permission; harass, bully, or threaten other users; post content that is sexually explicit or exploits minors; interfere with the proper functioning of the Platform; or use the Platform to facilitate immigration fraud.

Certain services on the Platform require payment, including but not limited to Green Card (DV Lottery) registration assistance, premium listings, and photo enhancement services. All payments are processed securely through Stripe. Prices are displayed in US Dollars (USD). By making a payment, you agree to the specified price at the time of purchase. Refunds may be issued at our discretion within 30 days of purchase if the service has not been delivered. For the Green Card registration service, please note that payment does not guarantee selection in the DV Lottery program, as selection is conducted solely by the U.S. Department of State.

TO THE FULLEST EXTENT PERMITTED BY LAW, RAMEXAR LLC and its owners, members, officers, employees, and affiliates shall NOT be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Platform. This includes, without limitation, damages arising from: reliance on any immigration or other information; interactions, disputes, or transactions with other users, businesses, or third parties; unauthorized access to your account or data; or any interruption, suspension, or termination of the Platform. In no event shall RAMEXAR LLC's total aggregate liability exceed the greater of (a) the total amount you paid to RAMEXAR LLC in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless RAMEXAR LLC and its owners, members, officers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your content or postings; (c) your violation of these Terms, any law, or the rights of a third party; or (d) any dispute or transaction between you and any other user or third party. RAMEXAR LLC reserves the right to assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with such defense.

The Platform includes marketplace features (jobs, housing, shipping, business listings, market items) and allows interaction between users. RAMEXAR LLC is only a neutral venue and is NOT a party to, and assumes NO responsibility for, any agreement, transaction, communication, payment, product, service, or dispute between users or between a user and any third party. We do not verify, endorse, or guarantee any listing, user, business, or content. You are solely responsible for evaluating and dealing with other users, and you assume all risk arising from such interactions, including the risk of fraud, misrepresentation, injury, or loss. Any dispute between users must be resolved directly between those users, and you release RAMEXAR LLC from any and all claims, demands, and damages arising out of such disputes.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be addressed through good-faith negotiation. If not resolved within thirty (30) days, it shall be resolved exclusively by final and binding individual arbitration administered in the United States under the rules of the American Arbitration Association, rather than in court. YOU AND RAMEXAR LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. You waive any right to a jury trial and to participate in a class action. Any claim must be filed within one (1) year after it arises, or it is permanently barred. If any portion of this section is found unenforceable, the remainder shall remain in effect.

You may delete your account at any time in Settings → Danger Zone → Delete Account. Upon account deletion, your profile data, posts, comments, and messages will be permanently removed. We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service or engage in prohibited conduct. Suspended or banned users may not create new accounts or use other accounts, devices or networks to access Gurbat (see Section 6).

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict-of-law principles. Any disputes shall be resolved as set out in the "Dispute Resolution" section above.
